Warranty conditions for LED – Elektron Berlin GmbH
Elektron Berlin GmbH, Saatwinkler Damm 60, 13627 Berlin – hereinafter referred to as the manufacturer – grants the warranty period valid at the time of purchase from the invoice date for LED products sold under the Elektron Berlin brand. This guarantee only applies to customers who have purchased the product for the first time in a member state of the EU or EFTA and operate it there.
The guarantee is granted under the following conditions:
- 1. The products are installed and used as intended and in compliance with the specified installation and operating conditions as stated in the available product information (operating instructions, type plate, product data sheet, etc.). Any missing information must be requested from the manufacturer. Relevant technical standards must be observed. Special, extreme installation conditions such as vibrations, humidity or special ambient air components must be agreed in writing with the manufacturer.
- 2. The installation and commissioning of the products is carried out professionally by a specialist in compliance with the installation instructions in the product information.
- 3. Cleaning and maintenance work is carried out regularly and professionally in accordance with the product information.
- 4. Changes to the product or services on the product, such as programming or setting the LED drivers, are carried out exclusively by the manufacturer.
- 5. The relevant, general and product-specific technical standards and regulations are complied with, in particular the permissible limit values for the ambient conditions and the electrical installation.
- 6. The products are not exposed to any mechanical, electrical or chemical stresses that go beyond their intended use.
- 7. The customer’s statutory warranty rights are not excluded, restricted or amended by these warranty conditions.
Warranty limitations:
- 1. This warranty does not apply to product failures that have already been remedied under warranty by replacement, repair or price reduction. The warranty period does not restart upon fulfillment of the warranty.
- 2. The warranty expires immediately if modifications, repairs, service work or troubleshooting are carried out on the products by the customer or third parties without the manufacturer’s prior written consent.
- 3. The warranty only covers product failures that are caused by proven material, design or production faults and are above the nominal failure rate. The average nominal failure rate of electronic products is 0.2% per 1000 operating hours. Any deviation from the specified operating conditions leads to an increase in the nominal failure rate.
- 4. Warranty claims due to defects resulting from inadequate protection of the product against overvoltage or inadequate quality of the electrical supply network are explicitly excluded.
- 5. The luminous flux and electrical output of a new LED product are subject to a technical tolerance of up to 10%. Color temperature and color rendering index are also subject to production-related tolerances. Deviations of products from the specifications in the product information in this respect do not constitute a warranty claim.
- 6. With LED products, a reduction in luminous flux of up to 0.6% per 1000 operating hours is the state of the art. The color temperature and color rendering index also change with the operating time. These technically induced signs of ageing do not constitute a warranty claim.
- 7. The guarantee does not apply to:
- a. All ancillary costs incurred in connection with the rectification of defects (warranty fulfillment) (e.g. for installation and removal, transport of the defective and the repaired or new product, disposal, travel and travel time, lifting equipment, scaffolding). These costs shall be borne by the customer.
- b. Wearing parts such as plug connections, cables or moving mechanical components.
- c. Plastic parts, e.g. made of polycarbonate, if they become discolored or brittle due to the natural aging process.
- d. Settings or parameterizations on systems that change due to wear, fatigue or contamination.
- e. Product components that are not part of the main functionality of the product, such as racks, Bluetooth modules, speakers, indicator lights, etc.
- f. Product errors which are attributable to software errors, bugs, viruses or similar.
- g. Services required from time to time, such as recommissioning after maintenance work, etc.
Warranty claims are handled exclusively by the manufacturer or by specialist companies or persons authorized by the manufacturer:

- 1. Warranty claims can only be asserted in writing within a period of 30 days after discovery of the defect and upon presentation of the proof of purchase and proof of the defect
- 2. Should it become apparent after inspection of the product that a warranty case has occurred, it is at the discretion of the manufacturer to repair the defective product, to supply an equivalent product free of charge or to offer a price reduction.
- 3. All replacement products or parts may contain new or recycled materials that are equivalent to new products or parts in terms of performance and reliability. The replacement product may differ from the original product in terms of dimensions and design. In the case of subsequent deliveries of LED products, there may be deviations in the lighting properties compared to the original products due to technical progress and use-related changes in, for example, luminous flux and color temperature of products. “Recycled materials” are parts or products that are used or refurbished and not new. Although such parts or products are not new, the condition after reconditioning or repair is as good as new in terms of performance and reliability. The functionality of all replacement products or parts is equivalent to that of the product or part to be replaced. Replacement products or parts will have the same remaining time of the applicable warranty period as the product being replaced or in which they are installed.
- 4. When providing warranty services, the manufacturer shall be liable, regardless of the legal grounds, exclusively in accordance with its General Terms and Conditions in the version current at the time the warranty is granted, which can be requested by the customer from the manufacturer or accessed at GTC. Otherwise, any liability for damages is excluded.
